Conflict Resolution in Hertfordshire: Why Choose Family Mediation?

In Hertfordshire, separating families from St Albans to WatfordStevenage, and beyond, face a critical decision about how to resolve disputes over children, property, and finances. Choosing pre-court Family Mediation offers a significantly quicker, more cost-effective, and less adversarial path than navigating the UK’s over-burdened Family Court system.

Time is Money: Mediation vs. The Courts

The most compelling advantage of mediation in Hertfordshire is the control it gives you over the timeline. The current reality of the Family Court system is one of prolonged delays, creating financial and emotional strain.

  • Mediation Timeline: The entire process, from your initial meeting to final  agreement, typically takes 2 to 4 months. Most cases are resolved in 3 to 5 joint sessions.
  • Court Timeline Reality: Family Court proceedings for private law matters  (children and finance) currently take an average of over 45 weeks (nearly a year) to reach a final decision. Delays and last-minute adjournments are common.

Making it Affordable: Government Financial Support

Family Mediation is considerably less expensive than engaging in a court battle. Furthermore, there are two key government-backed schemes designed to lower the cost for Hertfordshire residents.

1. The £500 Family Mediation Voucher Scheme

  • Financial Help: The government offers a £500 financial contribution towards your joint mediation costs.
  • Eligibility: This is available for cases concerning disputes over children’s arrangements (even if you are also discussing finances).
  • How  to Claim: Your Amity Family Mediation Council (FMC) Accredited Mediator will assess your eligibility and apply for the voucher directly on your family’s behalf. You do not have to apply yourself.

2. Legal Aid (Free Mediation)

Eligibility:  If you are on a low income or certain benefits, you may qualify for Legal Aid, which can cover the full cost of your MIAM and all subsequent mediation sessions.

The Shared Benefit: If only one party qualifies for Legal Aid, the other party automatically receives their MIAM and the first joint mediation session for free.

The Process: Your Step-by-Step Guide

Family Mediation is a structured process led by a neutral professional.

Step 1: The MIAM (Mediation Information and Assessment Meeting)

The law requires you to attend a MIAM before you can apply to the Family Court in places like Watford, St Albans, or Hemel Hempstead. This is an individual, confidential meeting with a mediator to:

Check your eligibility for Legal Aid and the £500 government voucher.

Step 2: Joint Mediation Sessions

If mediation is suitable, you will attend joint sessions with the mediator. These meetings are safe and constructive, with the mediator managing the discussions to help you:

Children: Draft a Parenting Plan that covers living arrangements, contact schedules, holidays, and decision-making for your children.

Finance:  Gather financial disclosure (assets, liabilities, incomes) and negotiate a fair settlement, which may be recorded in a Memorandum of Understanding (MOU).

Step 3: Formalising Your Agreement

Agreements made in mediation are usually not legally binding until formalised by a solicitor and approved by the court as a Consent Order. Crucially, the court’s job at this stage is to rubber-stamp the agreement you reached, rather than make the decision for you.
