MIAM stands for Mediation Information Assessment Meeting, which is a meeting that serves as an initial step in understanding mediation Simply put, it is an individual, confidential discussion between you and the family mediator, to allow for information to be exchanged.
The mediator needs to collect information about you, the person (or people) you want to mediate with, and the situation. This lets the mediator establish that it falls under the category of Family Mediation that might otherwise result in a court hearing, and that it is suitable and safe for mediation to continue. It also allows the mediator to provide you with essential information about the process, and on other ways to potentially resolve the issues and sign post any alternative support and/or legal advice you may wish to seek before or alongside using mediation.
Mediation offers a chance to consider resolving the issue through collaboration instead of pursuing court proceedings. However, mediation is not always suitable or successful. In such situations, it may be more appropriate for the matter to be decided in the Family Court and therefore a court application could be needed.
You do not need to exhaust mediation before making a court application. In most cases though, unless you can prove exemption, it is now compulsory to attach proof from your mediator of having attended a MIAM within the last 4 months or you risk having the application rejected. Exemption from attendance is only possible in very strict circumstances.
If looking to make an application at any stage of mediation, please therefore contact the office as soon as possible in order for us to supply an in-date confirmation of your attendance. If you contact us after the 4 months expire, you will need to attend a new MIAM first which could delay your court application.

Access to Court: Unless you qualify for exemption, it is now law for anyone wishing to make an application to the Family Court to find out about mediation and at the very least, attend a MIAM first. Even if you are using the services of a Solicitor, in most cases, they can't proceed unless you have a proof of attendance, so it can hold up your case, meaning you can face more costs. You may be asked by your Solicitor to attend a MIAM in order for them to continue with your court case. So in urgent situations it is vital to follow this step swiftly to allow a court application to be submitted.
