2. Joint Mediation Sessions
If mediation is suitable, you will attend joint sessions with the other party. The mediator facilitates the discussion, ensuring a balanced environment, and guides you through the complex issues:
Financial Settlement: Discussing the division of assets, property, pensions, and exploring spousal maintenance and child maintenance.
3. Formalising the Agreement (Memorandum of Understanding)
Once an agreement is reached, the mediator will draft two key documents:
- Memorandum of Understanding (MOU): This document outlines the details of your agreement.
- Open Financial Statement (OFS): This document summarises your financial disclosures.
These documents are not legally binding on their own. You will need to take them to a local solicitor in the Tyne and Wear area who will draft a legally binding Consent Order for approval by the court. This crucial step legally formalises your divorce settlement or separation agreement.
