WHAT IS MEDIATION?

Mediation Services Milton Keynes Family Child Contact

⚖️ Family Mediation: An Alternative to Court

Family mediation is a voluntary and confidential process that offers separating couples and families a constructive alternative to expensive, time-consuming, and adversarial court proceedings. Instead of having a judge impose a decision, mediation uses a neutral, accredited third party (the mediator) to help both sides communicate effectively, explore their options, and reach their own mutually acceptable agreements regarding children, finances, or property. This process puts the control and decision-making power back in the hands of the individuals involved, encouraging collaboration rather than conflict.

By fostering better communication and a shared commitment to the outcome, mediation often leads to more sustainable and lasting solutions that meet the unique needs of the family, particularly benefiting children by reducing parental conflict. It is typically quicker, significantly less costly, and less stressful than litigation, and in many jurisdictions, attending a Mediation Information and Assessment Meeting (MIAM) is a mandatory first step before applying to court for most private family law orders

Mediation - An Alternative to Family Court

Choosing family mediation as an alternative to court offers numerous compelling advantages, making it a preferred route for many separating couples. The fundamental appeal lies in retaining control over your own future. Unlike litigation, where a judge imposes a decision, mediation allows you and the other party to craft solutions tailored to your unique family circumstances, particularly regarding your children and financial future. This leads to agreements that are often more practical, durable, and satisfactory for both sides.

Key Perks of Family Mediation

Perk Explanation Control & Empowerment

You and your ex-partner, not a judge, make the final decisions. The mediator facilitates the conversation, but the power remains with you to agree on outcomes for children, property, and finances.

Cost-Effectiveness : Mediation is significantly less expensive than contested court proceedings, where legal fees can quickly accumulate. Furthermore,

Legal Aid and the Government Mediation Voucher Scheme (up to £500) may be available, reducing the cost further.

Speed & Efficiency : The process is typically much quicker than waiting for court dates, which can be subject to delays. Many agreements are reached within a few sessions over several weeks, rather than months or years of litigation.

Confidentiality Everything discussed in mediation sessions is confidential (with limited exceptions). This contrasts sharply with court, where hearings are generally public and financial details may be disclosed.

Reduced Conflict Mediation operates in a less adversarial and stressful environment than court. It focuses on cooperation and future-oriented problem-solving, which is demonstrably better for the emotional well-being of all involved, especially children.

Sustainable Outcomes Since both parties actively participate in developing the agreement, there is a

higher rate of compliance compared to decisions imposed by a court order. This also helps to establish a constructive basis for co-parenting after separation.

Focus on Children The process allows parents to keep the best interests of the children at the forefront, fostering better long-term co-parenting communication and shielding children from unnecessary adult conflict.

By opting for mediation, you are choosing a path that prioritizes collaboration, privacy, and sensible decision-making over confrontation and protracted legal battles.5

How much does mediation cost?
The cost of mediation vary with the services required, see our complete breakdown on mediation costs. Legal Aid is available.

You make the decisions

You maintain control as you are the decision makers.  Court can become necessary if a decision really can't be reached together but this may end up being something neither party wanted.

It's Less Stressful

Going to court can be a very stressful experience.  Whilst we understand mediation can also seem scary, it does tend to be a lot less stressful on the family as a whole and can often improve communication which is the best way to improve things for the future.

THE Mediation Process

Agreement Mediation child arrangements

Mediation Information Assessment Meeting (MIAM)

We start the mediation process  by meeting the two parties individually to assess if mediation is appropriate for your individual needs.  This decision is reached mutually between the Mediator and the client.

The meeting is used to discuss which of our mediation services is going to work best for your situation. We offer an Express service if you are looking to book  arrange an urgent MIAM.

Book Your MIAM Meeting Here
From your MIAM meeting to agreement, we are always on hand to explain the mediation process, and mediation costs

Joint Meetings

Once the MIAMs have been completed for both clients we then look to bring you into a meeting together to discuss arrangements.   We don't expect this to be an enjoyable experience but we hope it is constructive.
