Family Mediation in Wales: Finding a Way Forward

Family mediation is a confidential, voluntary, and constructive process designed to help families in Wales resolve disputes following separation, divorce, or civil partnership dissolution without resorting to the stress and expense of court. An impartial, accredited mediator helps you and the other party communicate effectively to make your own decisions about the future.


What Issues Can Mediation Resolve?

Accredited family mediators in Wales can help you discuss and agree on all practical aspects of your separation, creating an agreement that works for your family.


Area of Dispute and Details to be Resolved


Child Arrangements Where the children will live, when they spend time with each parent (contact/visitation), holiday schedules, key decisions about education or medical care.


Financial Matters Dividing assets such as the family home, savings, investments, and pensions.


Property Decisions about selling or transferring ownership of shared properties.


Child Maintenance Agreeing on financial support for the children.


🔑 Your Path to Mediation: The MIAM Requirement


In most cases in Wales, the first step before applying to the Family Court is to attend a Mediation Information and Assessment Meeting (MIAM).


  • What is a MIAM? It is an individual, confidential meeting with a qualified mediator where they explain how mediation and other non-court dispute resolution (NCDR) options work. They will also assess whether mediation is suitable for your case.
  • Why is it required? The courts strongly encourage families to use NCDR, like mediation, to resolve issues. Unless a specific exemption applies (e.g., domestic abuse or urgency), you must prove you attended a MIAM before you can apply for a court order regarding children or finance.


💰 Making Mediation Affordable: Funding Options in Wales


Concerns about cost should not prevent you from accessing mediation. Several options exist to make it affordable:

1. Legal Aid

  • Free Mediation: If you are on a low income or receive certain benefits, you may be eligible for Legal Aid, which would cover the full cost of the MIAM and all mediation sessions.
  • Support for the Other Party: If only one party qualifies for Legal Aid, the other party will also receive free funding for their MIAM and the first joint mediation session.
  • How to Check: Accredited mediators with a Legal Aid contract will be able to assess your eligibility and guide you through the process, which requires providing evidence of your income and savings.

2. Government Mediation Voucher Scheme

  • £500 Contribution: The UK Government operates a voucher scheme that provides a one-off financial contribution of up to £500 per family towards the costs of joint mediation sessions.
  • Eligibility: The voucher is available to families who have a dispute about child arrangements (with or without financial issues) and is designed to encourage out-of-court resolution.
  • How to Apply: You do not apply for the voucher directly. Your accredited mediator will assess your case during the MIAM and apply for the funding on your behalf if you are eligible and the voucher is still available.

3. Private Fees

If you are not eligible for Legal Aid or the voucher scheme, you will pay a private fee. This is still typically significantly less than the cost of taking a case to court. Mediators often charge on a sliding scale or a fixed hourly rate, so you should ask about their fees when booking your MIAM.

Mae cyfryngu teuluol yn broses gyfrinachol, wirfoddol, ac adeiladol a gynlluniwyd i helpu teuluoedd yng Nghymru i ddatrys anghydfodau yn dilyn gwahanu, ysgariad, neu ddiddymiad partneriaeth sifil, heb droi at straen a chost y system lys. Mae cyfryngwr diduedd, achrededig yn eich helpu chi a'r parti arall i gyfathrebu'n effeithiol er mwyn gwneud eich penderfyniadau eich hunain am y dyfodol.


Pa Faterion All Cyfryngu eu Datrys?

Gall cyfryngwyr teuluol achrededig yng Nghymru eich helpu i drafod a chytuno ar bob agwedd ymarferol ar eich gwahanu, gan greu cytundeb sy'n gweithio i'ch teulu.

🔑 Eich Llwybr i Gyfryngu: Gofyniad y Cyfarfod Gwybodaeth ac Asesu Cyfryngu (MIAM)

Yn y rhan fwyaf o achosion yng Nghymru, y cam cyntaf cyn gwneud cais i'r Llys Teulu yw mynychu Cyfarfod Gwybodaeth ac Asesu Cyfryngu (MIAM).

  • Beth yw MIAM? Mae'n gyfarfod unigol, cyfrinachol gyda chyfryngwr lle maen nhw'n esbonio sut mae cyfryngu ac opsiynau eraill i ddatrys anghydfod y tu allan i'r llys (NCDR) yn gweithio. Byddant hefyd yn asesu a yw cyfryngu'n addas ar gyfer eich achos.
  • Pam mae ei angen? Mae'r llysoedd yn annog teuluoedd yn gryf i ddefnyddio NCDR, fel cyfryngu, i ddatrys materion. Oni bai bod eithriad penodol yn berthnasol (e.e., cam-drin domestig neu frys), rhaid i chi brofi eich bod wedi mynychu MIAM cyn y gallwch wneud cais am orchymyn llys ynghylch plant neu faterion ariannol.

💰 Gwneud Cyfryngu'n Fforddiadwy: Opsiynau Cyllid yng Nghymru

Ni ddylai pryderon am gost eich atal rhag cael mynediad at gyfryngu. Mae sawl opsiwn yn bodoli i'w wneud yn fforddiadwy:


1. Cymorth Cyfreithiol (Legal Aid)

  • Cyfryngu Am Ddim: Os oes gennych chi incwm isel neu os ydych chi'n derbyn budd-daliadau penodol, efallai y byddwch chi'n gymwys i gael Cymorth Cyfreithiol (Legal Aid), a fyddai'n talu cost lawn y MIAM a'r holl sesiynau cyfryngu.
  • Cymorth i'r Parti Arall: Os mai dim ond un parti sy'n gymwys i gael Cymorth Cyfreithiol, bydd y parti arall hefyd yn derbyn cyllid am ddim ar gyfer eu MIAM a'r sesiwn cyfryngu ar y cyd gyntaf.
  • Sut i Wirio: Bydd cyfryngwyr achrededig sydd â chontract Cymorth Cyfreithiol yn gallu asesu eich cymhwysedd a'ch tywys drwy'r broses, sy'n gofyn am ddarparu tystiolaeth o'ch incwm a'ch cynilion.

2. Cynllun Talebau Cyfryngu'r Llywodraeth

  • Cyfraniad £500: Mae Llywodraeth y DU yn gweithredu cynllun talebau sy'n darparu cyfraniad ariannol untro o hyd at £500 y teulu tuag at gostau sesiynau cyfryngu ar y cyd.
  • Cymhwysedd: Mae'r daleb ar gael i deuluoedd sydd ag anghydfod am drefniadau plant (gyda neu heb faterion ariannol) ac fe'i cynlluniwyd i annog datrys y tu allan i'r llys.
  • Sut i Wneud Cais: Nid ydych chi'n gwneud cais am y daleb yn uniongyrchol. Bydd eich cyfryngwr achrededig yn asesu eich achos yn ystod y MIAM ac yn gwneud cais am y cyllid ar eich rhan os ydych chi'n gymwys a bod y daleb ar gael o hyd.

3. Ffioedd Preifat

Os nad ydych chi'n gymwys i gael Cymorth Cyfreithiol neu'r cynllun talebau, byddwch chi'n talu ffi breifat. Mae hyn yn dal i fod yn sylweddol llai na chost mynd â'ch achos i'r llys. Mae cyfryngwyr yn aml yn codi tâl ar raddfa symudol neu gyfradd fesul awr sefydlog, felly dylech ofyn am eu ffioedd wrth archebu eich MIAM.
