👨‍👩‍👧‍👦 Stages of Family Mediation (Luton, Bedford, Central Beds)

  

Family mediation is the most common form of mediation in Bedfordshire, often required before parties can apply to the Family Court for child arrangements or financial orders.

1. The Mediation Information and Assessment Meeting (MIAM)

  • Initial Step: This is the required first stage for most family applicants. It is a confidential, individual meeting with an accredited mediator. 
  • Purpose: The mediator explains how mediation works, assesses whether the case is suitable for mediation (screening for domestic abuse or other vulnerabilities), discusses other options for resolution, and confirms if the applicant qualifies for Legal Aid or the Government's £500 Family Mediation Voucher Scheme to families in Bedford, Luton and the surrounding areas mentioned above. 
  • Outcome: If mediation is deemed suitable and the parties agree to proceed, the process moves to the next stage. If mediation is unsuitable or one party refuses to attend, the mediator will sign the relevant court form (FM1, Form A or C100) allowing the applicant to take the matter to court.

2. Information Gathering and Preparation

  

  • Financial Cases: If the dispute involves finances, both parties are required to prepare a full, honest disclosure of their financial circumstances, including assets, debts, income, and liabilities. The mediator helps ensure this information is exchanged clearly.
  • Children Cases: Both parties focus on their children's needs and may discuss the option of Child-Inclusive Mediation (CIM), where the children (if appropriate and with parental consent) meet separately with the mediator to have their voice heard. 

3. Joint Mediation Sessions

  

  • The Discussions: The mediator facilitates a constructive meeting (or a series of meetings, often lasting 1-2 hours each) where the parties discuss the issues—such as where the children will live, contact      arrangements, or how assets will be divided. 
  • Mediator's Role: The mediator keeps the conversation balanced, manages conflict, helps the parties explore realistic options, and encourages them to focus on mutual interests rather than fixed positions.
  • Shuttle Mediation: If being in the same room is difficult, the mediator can conduct sessions by moving between separate rooms (shuttle mediation) or via remote video conferencing. 

4. Concluding the Agreement

  

  • Outcome Documents: When an agreement is reached, the mediator records the details in formal documents: 
  • Memorandum of Understanding (MOU): Outlines the proposed agreements reached by the parties. 
  • Open Financial Summary (OFS): A summary of the financial information disclosed and used to reach the agreement.
  • Parenting Plan: Details the arrangements for the children.
  • Legal Formalisation: These documents are not legally binding until the parties take them to their respective solicitors to be converted into a Consent Order (for finances) or a court order (for children) and approved by a judge.

🏢 Stages of Civil and Commercial Mediation

  

Civil mediation (used for business, contract, property, or workplace disputes) typically condenses the process into a single, comprehensive day.

1. Pre-Mediation Preparation

  

  • Appointment: The parties agree on and appoint a mediator, and sign a Mediation Agreement outlining the confidentiality and procedures.
  • Position Papers: Each party provides the mediator with a Position Statement (and often a confidential supplementary note) that summarises their case, the history of the dispute, costs incurred, and their objectives for the mediation. 

2. Joint Opening Session (Plenary)

  

  • Mediator's Introduction: The mediator welcomes the parties, explains the ground rules, stresses the confidentiality of the process, and outlines the day's agenda. 
  • Party Statements: Each party (often through their solicitor/barrister, or sometimes by reading a statement themselves) presents their view of the dispute, ensuring everyone feels heard. 

3. Private CONSIDERATIONS and Negotiation

  

  • Core of the Day: This is where the bulk of the negotiation happens. The parties retire to separate rooms (or private video channels), and the mediator moves between them. 
  • Reality Testing: The mediator helps each party understand the strengths and weaknesses of their own case and the risks and costs of going to court.
  • Option Generation: The mediator facilitates the exchange of offers and  counter-offers, focusing on creative solutions that a court might not be able to order. 

4. Settlement and Finalisation

  

  • Agreement: If a settlement is reached, the parties or their legal representatives meet to draft a final, legally binding document, often called a Settlement Agreement or, if court proceedings have started, a Tomlin Order.      
  • Conclusion: The formal document is signed, concluding the dispute immediately and avoiding the need for further litigation.
